Renting or being a tenant of a property can come with a lot of confusion when an important property issue like plumbing arises. There are many points of contention for when something is a tenants’ responsibility and when it is a landlords’, however this guide will help identify the key points as outlined by the Residential Tenancies Act (RTA) which is the main governing body for renters and tenants in Australia.

Please note, while this guide is following the RTA regulations, your tenancy agreement may have different definitions. Please review your rental contract if you are unsure.

Emergency Plumbing Problems
In almost all cases, renters covered under the Residential Tenancies Act (RTA) should find their own plumber in an emergency.

Issues that are not deemed as an emergency should be coordinated with your landlord, body corporate or real estate agency as per your own agreements set out in your contract.

But what is an emergency?
In general terms the RTA defines an emergency as any repair that cannot wait until the following day for attention.
For example, in terms of plumbing, this could be:

  • A burst water service
  • A serious water service leak
  • A serious roof leak
  • Flooding or serious flood damage
  • A failure or breakdown of the water supplies to the premises
  • A failure or breakdown of an essential service or appliance on the premises (e.g. for hot water)

For any issue that is an emergency should be handled immediately for the safety of yourself and to protect the property from further damage.

Other Plumbing
Some plumbing issues are difficult territory for both tenants and landlords. This is normally a contention with what is considered a ‘maintenance’ or a ‘repair’.

  • Maintenance
This refers to fixes to plumbing on the property that is caused by general wear and tear and aren’t urgent.
  • Repair
This refers to fixes to plumbing on the property for something that is broken or damaged and needs to be fixed quickly.

Landlords are responsible for maintenance and repairs are handled as a case by case basis. However occasionally a maintenance plumbing issue might not be a responsibility of the landlord. If there is an issue that is a result of the tenant’s own actions that will need to be sorted out by the tenant.

For example, if a toilet has been blocked by non-flushable items or hair has built up in the drain.
For these cases, it is often the responsibility of the renter or tenant to get these fixed.

If you have a maintenance issue similar to the ones above that you need to solve as a tenant, The Brisbane Plumbers don’t just handle emergency call-outs. The Brisbane Plumbers are experienced in all plumbing requirements from fixture replacements to drainage issues.
